Our Privacy Policy outlines how we collect, store, use, and share your data when you sign up for and use our parking services through our parking app or portal as part of the course of our business (our “Services”).
By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time. Where changes to the Privacy Policy are material, we will provide you with reasonable notice before the changes take effect. We encourage you to check our website, app or portal periodically to ensure that you are aware of our current Privacy Policy.
- What is personal information?
When we refer to “personal information”, we mean information or an opinion about you, from which you are, or may reasonably be, identified. This information may include (but is not limited to) your name, phone number, email address and address.
- Information We Collect
The personal information we collect depends on the nature of our relationship with you.
We may collect personal information when you:
- enter into an agreement with us to provide or receive a product or service;
- (or an organisation you are associated with) opens an account with us;
- visit or use our website, portal or mobile app or when you visit us in person;

- User Identity: Name, email, phone number, vehicle model, make, colour and registration number.
- Location Data: Real-time GPS location to facilitate parking services.
- Parking History: Bookings, check-ins and check-outs, parking duration, parking overstays, payment history, and past usage.
- Additional information: relating to you that you provide to us directly in any other form, for example, customer survey responses, customer feedback, information you include in support tickets or any other personal information that you provide to facilitate your dealings with us.
Technical data
- Device Information: Device type, operating system, browser details.
- Location: geo-location information.
- Usage Data: App interactions, preferences, troubleshooting logs.
- Cookies & Tracking: To improve app functionality and user experience.
We usually collect personal information directly from you and only by lawful and fair means and not in an unreasonably intrusive way.
There may be times when we source personal information about you from a third party. These third parties may include (but are not limited to):
- building, facility, strata and other property managers and site administrators who use our services;
- a marketing company;
- someone duly authorised to act on your behalf; and
- where you have provided consent, for example, from your referees.
We may also automatically collect non-personal information through the standard operation of our information systems infrastructure.
We do not ordinarily collect “sensitive information” (as defined under relevant privacy laws) from users of our website, app and portal.
We also do not knowingly seek or collect personal information from children under 16 years.
If you use a pseudonym when dealing with us or you do not provide identifiable information to us, we may not be able to provide you with any (or all) of our services that you request (depending on the circumstances). If you wish to remain anonymous when you use our website, do not sign into it or provide any information that might identify you.
- How We Use Your Data
We may use collected data for the following purposes:
- to enable access to parking services and app functionalities, for example, location data is collected to help app users find nearby parking spots;
- to process payments and verify transactions securely;
- to notify you of parking bookings and matters associated with your bookings, including notifications of end of bookings approaching, overstays potential penalties, app updates and promotions;
- to verify your and your vehicle’s identity for authorising access to private property;
- to enhance our customer support to you and troubleshoot technical issues;
- to operate, protect, improve and optimise our products, website, Services, app, portal, business and our users’ experience, such as to perform analytics, conduct research and for advertising and marketing;
- to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
- to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;
- to detect fraudulent activity and ensure compliance with legal obligations and requirements;
- to resolve any disputes that we may have with any of our users, and enforce our agreements with third parties; and
- any other purpose you have consented to.
We use location data of app users to:
- help users to find nearby parking spots;
- optimise parking availability; and
- assist with navigation and enforcement.
If you are an app user, you can disable location services in your app device settings but this may limit the way in which you can use our app.
We do not sell personal information to third parties.
Do we use your personal information for direct marketing?
We and/or our carefully selected business partners may send you direct marketing communications and information about our service or products where you have consented to receiving these marketing communications. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. You may opt-out of receiving marketing materials from us by contacting us at support@parkingspotz.com or by using the opt-out facilities provided (eg an unsubscribe link) in our marketing messages.
- Disclosures of Personal Information
Your personal information may be disclosed to third parties in the circumstances below.
We may share data (including personal information) with:
- Our related bodies corporate.
- Building, Facilities, Strata and other Property Managers or other site administrators when you are parking on their private property and they need to authorise permissions for you to access their restricted private site and to facilitate bookings and manage parking access.
- Parking Operators to facilitate bookings and manage parking access.
- Payment Processors (e.g., Stripe, PayPal) for secure transactions.
- Third party service providers who assist us in operating our Services, including those who assist us with the following:
- hosting and infrastructure;
- positioning technology;
- data analysis and improvement of our Services; and
- marketing and communication efforts, such as digital asset management.
- Government Agencies, law enforcement agencies, courts or tribunals or as otherwise required or authorised by law.
- Our professional advisors, such as our lawyers, accountants, tax advisors and auditors.
- Analytics Providers to improve user experience.
- Specific third parties authorised by you to receive information we hold about you.
We may disclose your personal information to a trusted third party (such as a building, facility, strata or other property manager) who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive.
All third party service providers must comply with strict security and privacy standards.
We reserve the right to transfer information (including your personal information) to a third party in the event of a sale, merger or other transfer of all (or substantially all of) the assets of Parking Spotz provided that the third party agrees to adhere to the terms of this Privacy Policy and handles personal information in accordance with the Australian Privacy Principles.
- Data Security and Retention
We collect and store personal data in Australia in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
We take reasonable steps to protect your personal information from misuse, interference and loss as well as from unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information. However, we cannot guarantee the security of your personal information.
To protect user data, including personal information, we implement:
- Encryption: Secure transmission and storage of sensitive information.
- MFA: (Optional) Two-factor authentication to add an extra layer of security.
- Access Controls: Restricting data access to authorised personnel only.
Regular Audits: We undertake security assessments to identify vulnerabilities.
We store your personal information:
- in Australia;
- for as long as your account remains active;
- to meet legal or regulatory obligations;
- until you make a deletion request (where applicable); and
- in either electronic or hard copy form.
We retain payment records for 7 years in compliance with legal obligations.

7.1 You have the right to:
- Access Data: Request a copy of your stored personal information.
- Correct Information: Update or rectify any of your details if they are incorrect.
- Delete Account: Request permanent deletion (subject to retention policies) of your account.

You will not be charged for making a request but you may be charged for the reasonable time and expense incurred in compiling information in response to an access request.
We may decline your request in certain circumstances in accordance with the APPs. If we do refuse your request, we will provide you with a reason for our decision and, in the case of a request for correction, we will include a statement with your personal information about the requested correction (if you ask us to do so).
- Cookies & Tracking Technologies
Our app and web portal use cookies to:
- Improve functionality and personalise user experience.
- Store login credentials for seamless access.
- Analyse app performance and troubleshoot errors.
You can disable cookies via browser settings but our app and web portal may not work as intended for you if you do so.
We may also use cookies to enable us to collect data that may include personal information. For example, where a cookie is linked to your account, it will be considered personal information under the Privacy Act. We will handle any personal information collected by cookies in the same way that we handle all other personal information as described in this Privacy Policy.
- Updates & Changes to our Privacy Policy
We may modify this Privacy Policy periodically. We will notify you of major updates and they will be posted on our website, portal and parking app. Where changes to the Privacy Policy are material, we will provide you with reasonable notice before the changes take effect. If you continue to use our website, portal or parking app after the effective date of the changes, you will be taken to have accepted the amended Privacy Policy.

If you think we have breached the Privacy Act or you wish to make a complaint about the way we have handled your personal information, you can contact our Privacy Officer using the contact details below.
Please include your name, email address and/or telephone number and clearly describe your complaint.
Our Privacy Officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint.
Your complaint will then be investigated. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.
In most cases, we will investigate and respond to a complaint within a reasonable time, usually within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.
If you are not satisfied with our response to your complaint, you may make a complaint to the Office of the Australian Information Commissioner (OAIC). The OAIC can be contacted by telephone on 1300 363 992 or by using the contact details on the website www.oaic.gov.au.
